I. Minimum Qualification Requirements:
Education : Bachelor of Laws
Experience : Two (2) years of relevant experience
Training : Eight (8) hours of relevant training
Eligibility : RA 1080
II. Duties & Responsibilities:
- Draft the Complaint for Expropriation case, the required copies of which are to be submitted to the Legal Services with a request that the Verification/Certification portion be signed by the Administrator, and the signed copies to be either referred to the OSG/OGCC for prosecution or returned to the Region for filing and prosecution
- Approve the prepared documents relative to acquisition of right-of-way and real properties and disposal of properties within the Region
- Draft the initiatory pleading in connection with ISF collection cases within the Region the required copies of which are to be submitted to the Legal Services with a request that the Verification/Certification portion be signed by the Administrator, and the signed copies to be either referred to the OSG/OGCC for prosecution or returned to the Region for filing and prosecution
- Approve, sign and issue demand letters to delinquent farmers within the region on ISF Back Accounts
- Draft Complaint/Answer and other subsequent pleadings in relation to other cases filed by or against NIA, to be either referred to the OSG/OGCC for prosecution or to filed and prosecuted by himself/herself, upon the instruction of the Manager of the Legal Services
- Draft Appeal/ Memorandum and other subsequent pleadings in relation to the Notice of Disallowances issued by the Commission on Audit (COA) against NIA employees within the Region
- Appear before the courts and quasi-judicial bodies, subject to the prior deputization by the OGCC/OSG, in the prosecution and/or defense of all cases within the Region, upon the referral of the Manager of the Legal Services
- Lead the Conduct of fact-finding investigations and formal investigations of administrative cases of employees below Salary Grade 24 within the Region and coordinate with appropriate agencies in the prosecution of criminal cases, upon directive of the Manager of the Legal Services
- Prepare legal opinion or legal advice on matters involving the interpretation of NIA Charter and other laws, policies, rules and regulation (i.e., FISA, RA 9184, RA 10752, etc.) on matters or issues with regional level implication or application referred for action, or that which the approving authority under the Revised Delegation of Authorities is the Regional Manager or below
- Prepare legal covers and request for comprehensive report with recommendations as directed by the NIA Regional Managers
- Perform work as member of the secretariat, technical working group (TWG), chairperson/vice-chairperson and other capacities of various Committees (Investment Committee, Contract Termination Review Committee [CTRC]), Special Project Committees, Asset Disposal, etc.) concurrently with its regular work, created internally within NIA or externally with other government agencies;
- Submit annual status report of 1) all cases involving the Agency appeared for and/or being handled; 2) all pending/resolved administrative cases of employees; 3) accomplishment pertaining to acquisition of right-of-way and real properties and disposal of properties, preparation of bid documents, contracts, agreements, legal instruments, legal opinion, advice, memoranda, for monitoring and record purposes
- Perform contract review of vital documents relating to contract agreements (Deed of Sale, Contract of Lease, Deed of Donation, Memorandum of Agreement, etc)
- Perform other related function.
